By accessing Seacoast Brokers, LLC's ("Seacoast") electronic services and applications, you agree to be bound by the following Terms and Conditions (the "Terms").

In these Terms: "you", "your", and "yours" means the person(s) accessing Seacoast's electronic services and applications; "we", "us" and "our" means Seacoast Brokers, LLC, its affiliates and subsidiaries.

Links to Other Sites

Seacoast's electronic services and applications may contain links to other websites not operated by us and over which we have no control. When you link to another site, you should review the Terms and Privacy Statement of that site.

No Unlawful or Prohibited Use

You agree not to use Seacoast's electronic services and applications in any way that may be illegal, or to alter or tamper with its content. As a condition of using Seacoast's electronic services and applications, you further agree:

  • Not to access or attempt to access any electronic service or application of which you have not been explicitly granted access;
  • Not to share any password assigned to or created by you with anyone else;
  • Not to use the electronic service or application in any manner which damages, disables, or impairs its functionality;
  • Not to copy, modify, reproduce, publicly display or create derivative works involving the content;
  • Not to provide us with any false information in connection with the information you submit to us

For Seacoast's insurance partners, including retail agents, brokers, loss adjusters, or sub-contractors, who have access to Seacoast's electronic services and applications, you further agree:

  • Not to facilitate or permit any person who is not employed or otherwise engaged by your company to access or attempt to access any of Seacoast’s electronic services and applications and
  • To notify Seacoast in the event that any employees or contractors who currently have access to Seacoast’s electronic services and applications have been terminated by you so their access may be discontinued by us

Use of Communication Services

The Seacoast electronic services and applications may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.

Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.

Violate any applicable laws or regulations.

Seacoast reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Seacoast reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever. Seacoast does not control or endorse the content, messages or information found in any Communication Service and, therefore, Seacoast specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. WE ACCEPT NO RESPONSIBILITY IF THE INFORMATION IS COMPLETE, INACCURATE OR OUTDATED. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. ADVICE RECEIVED VIA THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS SHOULD NOT BE RELIED UPON FOR PERSONAL, MEDICAL, LEGAL OR FINANCIAL DECISIONS AND YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR SPECIFIC ADVICE TAILORED TO YOUR SITUATION.

SEACOAST AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. SEACOAST AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SEACOAST AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS, WITH THE DELAY OR INABILITY TO USE THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS, OR OTHERWISE ARISING OUT OF THE USE OF THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. YOU MAY DISCONTINUE USE OF THE SEACOAST ELECTRONIC SERVICES AND APPLICATIONS AT ANY TIME.

Termination/Access Restriction

Seacoast reserves the right, in its sole discretion, to terminate your access to the Seacoast Electronic Services and Applications and the related services or any portion thereof at any time, without notice.

To the maximum extent permitted by law, this agreement is governed by the laws of the State of South Carolina, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Charleston County, South Carolina, U.S.A. in all disputes arising out of or relating to the use of the Seacoast Electronic Services and Applications. Use of the Seacoast Electronic Services and Applications is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Seacoast as a result of this agreement or use of the Seacoast Electronic Services and Applications. Seacoast shall comply with governmental, court and law enforcement requests or requirements relating to your use of the Seacoast Electronic Services and Applications or information provided to or gathered by Seacoast with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Seacoast with respect to the Seacoast Electronic Services and Applications and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Seacoast with respect to the Seacoast Electronic Services and Applications.

We hold copyright, trademarks and other intellectual property rights relating to the Seacoast Electronic Services and Applications, the rights of which you cannot acquire by accessing the Electronic Services and Applications. The use of such material would constitute an infringement of our rights unless express written permission is obtained.
